AREONX CRYPTOCURRENCY EXCHANGE

ARBITRAGE ACTIVITY DECLARATION, UNDERTAKING AND INFORMATION FORM

1. PARTIES, SCOPE AND PURPOSE

This Arbitrage Activity Declaration, Undertaking and Information Form (the “Form”);

on the one hand, AreonX Cryptocurrency Exchange operating under Magician of Meta Crypto Asset Trading Platform Joint Stock Company (the “AreonX” or the “Platform”),

and on the other hand, the real or legal person user (the “User”) who opens an account on the AreonX platform, accesses the platform and/or trades crypto assets through the platform

is concluded electronically between the parties.

The purpose of this Form is to obtain the User’s explicit declaration that the transactions carried out or intended to be carried out on the AreonX platform may be of an arbitrage nature, to clarify the legal, financial and operational responsibility of such activities, and to enable AreonX to fulfill its compliance, risk management and audit obligations.

2. INFORMATION AND ACCEPTANCE REGARDING THE CONCEPT OF ARBITRAGE

The User;

acknowledges that arbitrage transactions are a type of transaction aimed at making profit by buying and selling the same crypto asset at different times on different platforms, exchanges or markets to benefit from price differences,
and that arbitrage activities may be evaluated as a high-risk transaction category by banks, payment institutions, financial institutions and regulatory authorities due to their characteristics such as high transaction volume, frequent transfers, multi-platform use, heavy order traffic and repeated transactions in short time intervals.

The User accepts that they are fully and sufficiently informed of these matters.

3. USER’S EXPLICIT DECLARATION REGARDING ARBITRAGE ACTIVITY

The User declares the following clearly, definitively, irrevocably and bindingly:

That all or some of the transactions carried out or planned to be carried out on the AreonX platform may be for arbitrage purposes,
That such transactions are carried out;
- on their own behalf,
- for their own account,
- under their own risk and responsibility,
That they do not carry out transactions on behalf of or for the account of another person, whether by proxy or in trust,
That they do not hold or manage funds on behalf of any person, group, organization or entity,

and accepts and undertakes these.

4. DECLARATION OF SOURCE OF FUNDS AND LEGITIMACY

The User;

declares that all fiat and crypto assets transferred to the AreonX platform or used in transactions on the platform;

are obtained from legitimate sources,
are not derived from crime,
have no direct or indirect connection with money laundering or the financing of terrorism,
and that the funds are obtained from;
- their personal income,
- commercial or professional activities,
- investment gains,

The User declares.

The User accepts in advance that any legal, criminal and administrative consequences arising from the contrary will be exclusively their own.

5. AREONX’S MONITORING, REVIEW AND INFORMATION REQUEST AUTHORITY

The User;

acknowledges in advance and unconditionally accepts that AreonX may;

monitor arbitrage transactions,
analyze them,
classify them,
evaluate them on a risk basis,
and, if deemed necessary;
- request additional information and documents,
- request transaction explanations,
- impose temporary or permanent transaction restrictions,

and declares that they accept these powers without reservation.

6. SHARING WITH BANKS, THIRD PARTIES AND PUBLIC INSTITUTIONS

The User;

due to arbitrage activities;

banks,
payment and electronic money institutions,
independent audit firms,
authorized public institutions and organizations

may request information and documents from AreonX,

AreonX may respond to these requests within the framework of legislation and to the extent necessary,

and such sharing will not constitute a personal data breach, a trade secret breach or a breach of contract,

which the User accepts, declares and undertakes.

7. RISKS AND LIMITATION OF LIABILITY

The User;

acknowledges that due to the nature of arbitrage transactions, they involve risks such as;

market volatility,
insufficient liquidity,
transfer delays,
blockchain network congestion,
disruptions originating from third-party platforms or infrastructure,

and accepts that AreonX bears no liability for damages that may arise from these risks.

8. FALSE, INCOMPLETE OR UNTRUE DECLARATION

The User;

if it is determined that the declarations in this Form are;

false,
incomplete,
misleading,

acknowledges in advance that AreonX has the right to;

suspend the account,
reduce transaction limits,
temporarily or permanently stop transactions and transfers,
unilaterally terminate the contractual relationship,
notify the competent authorities.

9. ELECTRONIC APPROVAL, EVIDENCE AND BINDING NATURE

This Form;

via the AreonX platform,
by logging into the User account,
is approved electronically

and enters into force without the need for any physical signature.

The User accepts that approvals given electronically are legally valid and binding.

9.1. Evidentiary Nature of Electronic Records

The User accepts that;

electronic approval records kept by AreonX,
system logs,
and IP address, date, time and transaction data

may be used as conclusive evidence in legal disputes, and that an evidence agreement is concluded within the scope of the Code of Civil Procedure (HMK).

9.2. Continuity of the Declaration

The declarations under this Form remain valid for the duration of the account relationship between AreonX and the User. The User is obliged to promptly notify AreonX of any changes in the nature or method of arbitrage activities.

9.3. Free Will and Informed Consent

The User declares that they approve this Form;

without being under pressure,
fully informed,
of their own free will.

9.4. Right to Update

AreonX may update this Form in line with legislative changes and risk management requirements. The updated text enters into force on the date it is published on the platform.

9.5. Integral Part

This Form is an integral part of the AreonX User Agreement, risk disclosures, compliance policies and all related internal regulations.

USER’S FINAL DECLARATION

“I declare that all or some of the transactions I carry out on the AreonX Cryptocurrency Exchange may be for arbitrage purposes, that due to the nature of these activities they may be subject to enhanced monitoring and review, and that I have read, understood and accept this Arbitrage Activity Declaration, Undertaking and Information Form voluntarily in electronic form.”
